Canadian Transportation Agency Imposes Corrective Measures on Air Canada, Air Nova and Canadian Airlines International

Ottawa, March 31, 1998 -- The Canadian Transportation Agency released today its second ruling on the complaint filed by Ms. Lucie Lemieux-Brassard in January 1997 in which she stated that she had encountered difficulties on 14 of the 17 flights she took across Canada over an 18-day period in the summer of 1996.
The carriers affected by this decision, i.e. Air Canada, Air Nova and Canadian Airlines International, are required to take the necessary steps to improve the manner in which accessible seating is identified on board their aircraft; enhance their wheelchair handling, repair and replacement procedures; and inform persons with disabilities of specific check-in procedures.
The Agency requires that the carriers make changes to their training programs, refresher courses and computer reservation system to ensure that employees are adequately trained and aware of the proper procedures to follow when dealing with persons with disabilities. The Agency also requires Air Canada and Canadian Airlines International to produce a brochure that will help passengers get quicker resolution of their problems when a mobility aid is damaged or lost. The carriers have 90 days to comply with the Agency's decision.
These additional measures are imposed on the carriers following public hearings held in Montreal last September. In its initial August 1997 ruling, the Agency found that on ten of the flights, there were seven contraventions of the Air Transportation Regulations and 15 undue obstacles to Ms. Lemieux-Brassard's mobility.
The Agency is of the opinion that, in partnership, the air industry, the community of persons with disabilities and the Agency can continue to work together to achieve a more accessible air transportation network.
The Agency is a federal quasi-judicial tribunal whose procedures are governed by the rules of natural justice which ensure that all parties in a complaint are dealt with in a fair and equitable manner.
